Terms of Service

By accessing or using the Total Virility platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you and Total Virility.

Total Virility is a technology platform that allows consumers to order laboratory blood tests online. We coordinate with independent, CLIA-certified laboratories to facilitate test ordering, sample collection, and the delivery of results through our platform.

Total Virility is not a medical provider, physician practice, healthcare facility, or clinical laboratory. We do not employ or contract with physicians, nurses, or any licensed healthcare practitioners to provide clinical services through our platform.

The Service does not provide medical advice, medical diagnosis, or medical treatment. Nothing on this platform — including lab results, biomarker reference ranges, educational content, charts, trends, or any other information — should be interpreted as a medical opinion, clinical recommendation, or substitute for professional medical judgment.

Specifically, you acknowledge and agree that:

• Lab results displayed on our platform are reported by independent laboratories, not by Total Virility
• Reference ranges, flags (e.g., "high" or "low"), and educational descriptions shown alongside results are for general informational purposes only
• We do not interpret, analyze, or validate your lab results in any clinical capacity
• We do not make recommendations about medications, supplements, lifestyle changes, or any form of treatment
• We do not diagnose any medical condition or disease
• You should always consult a qualified, licensed healthcare professional to interpret your lab results and make any healthcare decisions
• You should never delay seeking medical advice, disregard medical advice, or discontinue medical treatment based on information obtained through the Service

If you are experiencing a medical emergency, call 911 or your local emergency number immediately. Do not rely on this platform for urgent or emergency medical needs.

You must be at least 18 years old and a resident of the United States to use the Service. Certain lab tests may not be available in all states due to regulatory restrictions. By creating an account, you represent and warrant that:

• You are at least 18 years of age
• You are a resident of the United States
• The information you provide is accurate, current, and complete
• You are ordering lab tests for yourself and not on behalf of another person unless that person has provided explicit consent

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Create only one account per person
• Use a strong, unique password and keep it confidential
• Notify us immediately of any unauthorized use of your account
• Not share your account credentials with any other person
• Not use the account of another person

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

When you place an order through the Service, you agree to pay the listed price for the selected lab panel. All prices are listed in U.S. dollars. All payments are processed securely through Stripe in accordance with PCI-DSS standards.

• Prices are subject to change without prior notice, but changes will not affect orders already placed
• All sales are final once a lab requisition has been generated
• Refunds for orders where the sample has not yet been collected are available upon request
• If a lab test cannot be completed due to a sample issue or laboratory error, we will offer a re-test or full refund at our discretion

Total Virility does not accept health insurance, Medicare, or Medicaid. The Service is a direct-to-consumer offering and all costs are the responsibility of the user.

All laboratory tests are performed by independent, CLIA-certified laboratories that are not owned, operated, or controlled by Total Virility. You acknowledge that:

• Laboratories are solely responsible for sample collection, processing, analysis, and result accuracy
• Results are typically available within 2–5 business days but may vary depending on the panel, laboratory workload, and sample logistics
• Total Virility is not responsible for delays, errors, or omissions caused by the performing laboratory
• Lab results may require confirmation through additional testing as recommended by a healthcare professional
• A single lab result is not sufficient to diagnose any medical condition

Our platform may display educational content about biomarkers, health topics, and general wellness information. This content is provided for general informational and educational purposes only. It is:

• Not personalized to your individual health situation
• Not a substitute for the advice of a qualified healthcare professional
• Not intended to be used for self-diagnosis or self-treatment
• Subject to change and may not reflect the most current medical research

We make no representations or warranties about the accuracy, completeness, or applicability of any informational content to your specific health circumstances.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal and health-related information. By using the Service, you consent to the practices described in the Privacy Policy.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Provide false, misleading, or fraudulent information
• Create multiple accounts for the same person
• Attempt to gain unauthorized access to our systems, other user accounts, or laboratory systems
• Interfere with, disrupt, or place an undue burden on the Service
• Use automated tools (bots, scrapers) to access the Service without our written permission
• Resell, redistribute, or commercially exploit the Service or any data obtained through it
• Use the Service to obtain lab results for the purpose of self-diagnosis or self-treatment without consulting a healthcare professional

All content, trademarks, logos, designs, and materials on the Service are the property of Total Virility or its licensors and are protected by U.S. and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

Your lab results and personal data remain your property. You grant us a limited license to store, display, and transmit this data solely to provide the Service to you.

To the maximum extent permitted by applicable law:

• Total Virility shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service
• Total Virility shall not be liable for any damages arising from your reliance on lab results, informational content, or any other data provided through the Service
• Total Virility shall not be liable for the acts, omissions, errors, or negligence of any independent laboratory
• Our total aggregate liability for any claims arising from the Service shall not exceed the amount you paid to Total Virility in the 12 months preceding the claim

You expressly acknowledge that Total Virility does not provide medical services and shall have no liability whatsoever for any health outcomes, medical decisions, or treatment choices made based on information obtained through the Service.

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We specifically disclaim:

• Any warranty of merchantability or fitness for a particular purpose
• Any warranty that the Service will be uninterrupted, timely, secure, or error-free
• Any warranty regarding the accuracy, reliability, or completeness of lab results or informational content
• Any warranty that the Service meets your specific health or medical needs

You agree to indemnify, defend, and hold harmless Total Virility and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of a third party
• Any health decisions or actions you take based on information obtained through the Service

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

You agree that any claims shall be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may delete your account at any time by contacting us. Upon termination:

• Your right to access the Service ceases immediately
• We may retain your data as required by law or as described in our Privacy Policy
• Sections of these Terms that by their nature should survive termination will continue to apply

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through a prominent notice on the Service at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
